Matching Terms of the Care Companion Meeting Point

For care companions, families and home care services – search for free, fee only after a successful match.

§ 1 Provider and scope

The “Care Companion Meeting Point” (Treffpunkt Pflegebegleitung, hereinafter the “Meeting Point”) is operated by ebrk UG (haftungsbeschränkt), Ginsterweg 2a, 41379 Brüggen, represented by its managing director Benedikt Krause, Amtsgericht Mönchengladbach HRB 20921, VAT ID DE354366307, phone +49 (0)176 60812012, e-mail info@care-assistant.com (hereinafter “we”).

These terms apply to the use of the Meeting Point at care-assistant.com and mobile.care-assistant.app by care companions (people who offer support), families (people in need of care and their relatives who are looking for support) and home care services (outpatient care and support services). Our Terms and conditions additionally apply to the subscription to the care software.

§ 2 What the Meeting Point does – and what it does not do

We bring together people who are looking for support and people who offer support. For this purpose, we provide profiles, requests, suggestions, a protected chat, confirmation of a match and tools for subsequent scheduling of visits.

§ 3 Registration, verification and visibility

  1. Use requires a user account. Users must be of legal age and provide truthful information. Accounts are activated after we have checked them.
  2. A care companion's profile only becomes visible to others once the companion has made it visible themselves, has agreed to these terms and we have verified their identity. Further checks (e.g. driving licence, qualifications, inspection of a certificate of good conduct (Führungszeugnis)) are carried out depending on the offer and are shown as “verified” in the profile. We do not store copies of identity documents or certificates of good conduct, only the date of the check.
  3. A verification note only confirms the specific fact that was checked. It is not a guarantee of personal or professional suitability. Whoever employs a companion decides for themselves whether the companion is suitable for the specific task.

§ 4 Obligations of all users

§ 5 The matching process

  1. A family or home care service creates a request; the Meeting Point suggests suitable companions. Companions see suitable requests.
  2. Either side can express interest. A protected chat is only unlocked once both sides have expressed interest.
  3. The parties get to know each other (chat, phone, video or in person) and decide freely. They may get to know several people.
  4. A match is successful when, after mutual interest, both sides declare in the Meeting Point that they wish to begin the companionship (“Yes, we would like to start”). If one side says “No”, the contact ends at no cost.

§ 6 Fee

  1. Searching, viewing profiles, expressing interest, chatting and getting to know each other are free of charge.
  2. For each successful match (§ 5 no. 4), the searching party pays a one-off fee:
    • Families (private household): €100 incl. VAT
    • Home care services: €100 plus VAT
    The amount displayed in the Meeting Point before acceptance is decisive.
  3. Care companions pay no fee and no other charges – neither for registration nor for the match.
  4. The fee becomes due upon the successful match and is payable within 14 days of receipt of the invoice. We do not require advance payments.
  5. A further fee only arises in the case of a further successful match, for example with a different companion.

§ 7 Cooperation outside the Meeting Point

If a searching party and a companion who have expressed mutual interest via the Meeting Point begin a companionship within six months thereafter without confirming this in the Meeting Point, the fee under § 6 is likewise owed, provided that the companionship is based on the contact established via the Meeting Point. The searching party remains free to prove that the companionship is not based on this contact.

§ 8 Employment of the companion

  1. The employer is the family (private household) or the home care service. The employer bears all employer obligations, in particular registration (for Minijobs in private households via the household cheque procedure (Haushaltsscheckverfahren) of the Minijob-Zentrale), accident insurance, payment of at least the statutory minimum wage, income tax and social security.
  2. The employment assistant, earnings calculator and earnings monitor (Minijob limit) are aids provided without guarantee. The binding classification for tax and social security purposes is made by the employer or the employer's payroll.

§ 9 Scheduling and companion app

After a match, employers can schedule visits in the Meeting Point; companions record the start, end, tasks completed and any special observations in the companion app. The employer is responsible for this data; we process it on the employer's behalf. Home care services conclude a data processing agreement with us for this purpose. The monthly overview serves as the basis for payroll; the employer checks its accuracy.

§ 10 Liability

  1. We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act (Produkthaftungsgesetz).
  2. In the event of a slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical of the contract. Otherwise, liability for slight negligence is excluded.
  3. We are not liable for the conduct of users towards each other, for the performance of the companionship or for information in profiles and requests; the parties are responsible for these themselves.

§ 11 Term, termination, suspension

Use of the Meeting Point is for an indefinite period and can be ended at any time without notice – by e-mail or by deleting the profile. Fees that have already become due remain owed. In the event of breaches of these terms or a justified suspicion of misuse, we may make profiles invisible or suspend accounts.

§ 12 Information on the right of withdrawal for consumers

Right of withdrawal

You have the right to withdraw from the contract for the matching service within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded. The contract for the paid matching service is concluded when you declare in the Meeting Point that you wish to begin the companionship.

To exercise your right of withdrawal, you must inform us (ebrk UG (haftungsbeschränkt), Ginsterweg 2a, 41379 Brüggen, phone +49 (0)176 60812012, e-mail info@care-assistant.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the model withdrawal form below, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your notice of exercising the right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and at the latest within fourteen days from the day on which we receive notice of your withdrawal from this contract. We will use the same means of payment for this reimbursement that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement. If you requested that the service begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you inform us of the exercise of the right of withdrawal in respect of this contract, compared with the full scope of the services provided for in the contract.

Expiry of the right of withdrawal

The right of withdrawal expires when we have fully performed the matching service – that is, both sides have confirmed the companionship – and you, before your acceptance, expressly agreed that we begin performance before the end of the withdrawal period and confirmed your knowledge that you lose your right of withdrawal upon complete performance of the contract.

§ 13 Data protection

How we process personal data in the Meeting Point – profiles, requests, suggestions, chat, checks, matching, scheduling and the companion app – is described in the platform's privacy policy.

§ 14 Changes to these terms

We may amend these terms with effect for the future, for example in the event of changes in the law or new functions. The current version is available here. For a match, the version you agreed to when giving your acceptance applies; companions agree to an amended version the next time they make their profile visible.

§ 15 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG); in relation to consumers, only insofar as this does not deprive them of the protection afforded by mandatory provisions of the law of the country of their habitual residence. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.
